1. Acceptance of Terms

By accessing or using www.gratzerlab.com (the “Website”) and participating in any courses or programs offered by Gratzer Environmental Lab LLC (“GEL,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Website or participate in our courses.

GEL reserves the right to modify these Terms at any time. Continued use of the Website or participation in our courses after changes constitutes acceptance of the updated Terms.

2. Description of Services

GEL offers:

  • Online and in-person certification courses in environmental science, outdoor skills, and related topics.

  • Classes conducted in outdoor environments (e.g., woods, wetlands, nature reserves) and indoor locations (e.g., classrooms, partner facilities).

  • Photography and social media content related to courses, unless participants opt out (see Section 7).

3. User Responsibilities

By using the Website or participating in our courses, you agree to:

  • Provide accurate and truthful information when registering.

  • Comply with all applicable laws and regulations.

  • Respect the environment and follow safety guidelines during outdoor activities.

  • Refrain from disruptive, illegal, or harmful behavior.

  • Not reproduce, distribute, or use GEL’s content (text, images, logos, etc.) without prior written permission.

GEL reserves the right to refuse service or terminate participation for violations of these Terms.

4. Liability Disclaimer

Outdoor Activities:

  • Participation in outdoor classes (e.g., hiking, wetland exploration) involves inherent risks, including but not limited to injury, illness, or property damage.

  • GEL is not liable for any damages, losses, or injuries arising from your participation in outdoor activities, including but not limited to:

    • Slips, trips, or falls.

    • Exposure to weather conditions.

    • Encounters with wildlife.

    • Pre-existing medical conditions.

  • Participants are responsible for their own safety and must follow all instructions provided by GEL instructors.

Indoor Classes:

  • GEL is not liable for injuries or damages occurring on third-party properties where classes are held. Participants waive their right to sue GEL for any claims related to such injuries or damages.

General Disclaimer:

  • THE WEBSITE, COURSES, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

  • GEL DOES NOT GUARANTEE the accuracy, completeness, or usefulness of any information provided on the Website or in courses.

  • GEL IS NOT RESPONSIBLE for any indirect, incidental, or consequential damages (e.g., lost profits, business interruption) arising from your use of the Website or participation in courses.

5. Intellectual Property

  • All content on the Website (text, images, logos, course materials) is owned by GEL or its licensors and is protected by copyright and other intellectual property laws.

  • You may not reproduce, distribute, or use GEL’s content without prior written permission, except for personal, non-commercial use consistent with these Terms.

6. User-Generated Content

  • By submitting content (e.g., photos, testimonials, or assignments) to GEL, you grant GEL a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for promotional or educational purposes, unless otherwise agreed in writing.

  • You retain ownership of your content but agree that GEL may use it in marketing materials (e.g., social media, website) unless you opt out in writing.

7. Photography and Social Media

  • GEL may take photographs or videos of participants during courses for promotional or educational purposes (e.g., social media, website, marketing materials).

  • If you do not wish to be photographed, you must notify GEL in writing at least 48 hours before the course begins. Participants who opt out will not be included in group photos or videos.

8. Termination

GEL reserves the right to:

  • Terminate your access to the Website or participation in courses at any time, with or without cause.

  • Refund fees at its sole discretion, subject to its cancellation and refund policy (see Section 10).

9. Governing Law

These Terms are governed by the laws of the State of New York, USA. Any disputes arising from these Terms or your use of the Website shall be resolved in the courts of New York County, New York.

10. Refunds and Cancellations

  • Online Courses: Refunds are subject to GEL’s refund policy, which is available upon request.

  • In-Person Courses: Cancellations must be made at least 7 days prior to the course start date to receive a full refund. Cancellations made within 7 days of the course start date are non-refundable unless GEL cancels the course.

  • GEL reserves the right to cancel or reschedule courses due to low enrollment, instructor availability, or unforeseen circumstances. In such cases, participants will be offered a full refund or the option to transfer to another course.

11. Changes to Terms

GEL may update these Terms at any time. Continued use of the Website or participation in courses after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email or a notice on the Website.
